Eligible Veterans and Family Members
Applies to Veterans and other individuals who resided, worked, or were otherwise exposed for 30 days or more between August 1, 1953 and December 31, 1987.
Gives Veterans the right to file an action in the U.S District Court for the Eastern District of North Carolina. This is very different from a regular VA compensation claim, in that it can include pain and suffering damages.
The statute of limitations is two years from the date of the bill or 180 days after an individual’s claim is denied.
This statute will not apply to VA claims.
Covered Conditions
If you have a disability you believe was caused by contaminated water, you may be eligible for compensation. Under the PACT Act, it is now presumed you were exposed to contaminated water. A competent medical opinion could lead to service-connection for a condition not listed based on the presumption of exposure.
